These general conditions of sale govern the sale of customized items on sale on the website by:
LES BOUTIQUES LONGCHAMP, S.A.S. with capital of 1,000,000 euros, whose registered office is at 404 rue Saint Honoré, Paris 75001,registered in the Companies' Register under number 334 502 655 PARIS.
The act of placing an order implies full and entire acceptance of these General conditions of sale, which may be accessed at anytime on the site, especially when registering the order.
They form the sole agreement between the parties andprevail over any other document.
They may be modified at any time. The new general conditions of sale will apply to any order placed after they have been postedon the site.
The items on sale are delivered only to the 48 contiguous states as well as Alaska, Hawaii and Puerto Rico. Please note that we do not deliver to the following destinations: Midway Islands, Wake Islands, Wesern Sahara, Virgin Islands, and Northern Mariana Islands.
Orders placed on the site are for private individuals and companies who are "final buyers" other than for their resale. The resale ofLongchamp products is strictly forbidden by those who plan to sell as abusiness activity.

1. The items on sale
Cutomized items on sale are sold exclusively via the Longchamp website. www.longchamp.com . They are designed and manufactured to your specifications within the sole limits of the choices offered.

Prices are Ex-VAT, indicated in US dollars.
Prices may be changed at any time, it being understood that the items are invoiced on the basis of the price in force at the time ofplacing your order
The prices of the items do not include costs (shippingcosts, customs duties).
Customs duties or other local taxes may have to be paid on delivery to countries other than France. These duties are calculated when the order is placed and are payable with the order. You will therefore have nothing to pay on delivery and you will not have any declarations to makeor formalities to carry out.
The overall price of the order that you are considering placing is shown on the "Order review" screen, and includes the following information:
3. The order and confirmation of the transaction
When ordering, you will need to follow a procedure of4 customization steps which are as follows:

Onceyou have confirmed the contents of the "Shopping cart" screen, you may begin the order process.
STEP 1, SIGN IN:
Createyour account or identify yourself.
STEP 2, ADDRESSES:
Enter your billing and shipping addresses.
So that parcels can be delivered to the correct address as quickly as possible, the information you give will be analysed by Cybersource/UPS to check the validityof the address.
STEP 3, ORDER REVIEW:
Viewthe summary of your order (items ordered and total amount of the order) and correct any errors.
If you would like to offer the article as a gift, choose the gift option and add apersonal message.
By confirming your order, you are declaring that you accept it and all the General conditions of sale. You also accept that the systems we use to record the orderact as proof of the transaction and its date.
STEP 4, PAYMENT:

STEP5, ORDER CONFIRMATION:
Access the "Order confirmation" stage. At the same time, you will receive an email confirming your order, and this will act as an order form.
When your purchase has been shipped, you will receive a shipment confirmation by e-mail.
Important
You have 24 hours before your order goes into production to make any changes relating to the features of the items (colors,choice of metal buckles, etc.), as long as these changes do not lead to any change in the price. To do this, please contact the E-shopping customer service at: help-usa@eshopping.longchamp.com.
We reserve the right to cancel any order from a customer with whom we are in dispute over payment of a previous order.
4. Payment
Payment of your purchases is by bank card only, when you place the order (Carte bleue, Visa, Eurocard/Mastercard, American express, Discover, Diners Club).
Your bank card is debited no later than six (6) days after the placement of your order, in the currency thereof.
You may make your purchases in complete safety. The bank details that you transmit on line to a registered bank are confidential and carried out in a secured environment (SSL protocol).Payment card numbers are not conserved on our site, but on a banking establishment’s secure site.
Checks are carried out to ensure that the bank card address and invoice address match each other.
5. Reserve of ownership
We remain the owners of the items sold until the complete payment of the price.
6. Delivery and Reception
A guideline delivery date is shown on your order review. In all cases,your article(s) will be delivered to the address shown on your order within a maximum of 3 weeks of placing the order, unless there is mention of any special delays during holiday periods. Your parcel will contain an invoice.
Items are delivered by an independent carrier. They are insured by us until they are delivered.
Items may not be delivered to an approved Longchamp retail outlet, or to a Longchamp boutique.
Similarly, items may not be delivered to a delivery address equivalent to a post box.
Shipping costs are indicated in the "Order review",step 3 of the ordering process. The amount depends on the weight and volume of your parcel
It corresponds to 30% of the Goods value of your Shopping cart, with a minimum threshold value of $50 and a maximum limit valueof $80.
Precautions:
To avoid any complications regarding the receipt of your parcel, please read the following information carefully:
- UPS may deliver the package to the receiver named on the waybill or to any other person appearing to have authority to accept delivery of the shipment onthe receiver's behalf (such as persons at the same premises as the receiver or neighbours of the receiver).
- If you receive a note saying that UPS called to deliver, contact them immediately to arrange a new delivery date. If you do not accept delivery of the parcel, UPS may return it to us...
- You have received the shipment confirmation emailbut you haven't received your order:
For deliveries, the carrier is UPS. The dispatch confirmation email does not accept responses. If the delivery date given by UPShas passed (give an extra 2/3 days), you may contact them at the followingaddress: www.ups.com .
- You haven't received the shipment confirmationemail but the guideline delivery date shown on your order confirmation emailhas passed:

- If your items have not been delivered within 7days after the guideline delivery date, for any reason other than "forcemajeure":
You may, if you wish, cancel the sale (by registeredmail with a request for proof of receipt, under the terms of article L.121-20-3 of the Consumer code). You may exercise this right within 60 working days from the planned delivery date. You will thus be refunded all the money you have paid (including transport costs paid with the order) within a maximum of 30 days from receipt of the registered letter.
If you see that your parcel or article has beendamaged, please contact the E-shoppingcustomer service at: help-usa@eshopping.longchamp.com giving details of the damage observed (parcel damp, holed, open, etc.), as weneed to send a registered letter to the carrier within 48 hours.
7. No right of withdrawal
Considering the unique and customised nature of the article, the latter may not be returned or exchanged, in accordance with article L. 121-20-2 of the consumer code:
"The right of withdrawal may not be exercised, unless the parties agree otherwise, in contracts: (...) 3° For the supply of goods manufactured to the consumer's specifications or clearly customised...".
As a result, you have no option to claim any right of withdrawal.
We therefore recommend that you give the time and attention required for designing your article.
8.Visible defects - Non-compliance
You should check the condition of the delivered article. If you find a visible defect, you have 7 days from the date of delivery inwhich to make a complaint to theE-shopping customer service at help-usa@eshopping.longchamp.com. Once your complaint has been validated, your contact will send you a "ReturnForm" which must be attached to your returned parcel.
Once the 7-day period has elapsed, the article will be deemed to be free of any visible defects. Our Custom bags workshop has the sole authority to judge the validity of the return.
If you note that the delivered article does not match your order confirmation, please contact the E-shopping customer service at us at help-usa@eshopping.longchamp.com.Once your complaint has been validated, your contact will send you a "Return Form" which must be attached to your returned parcel.
In the event of a visible defect or proven non-compliance, we will paythe return costs of the article. Please make sure that you return your article in its original condition, with its packaging, via UPS that allows you to monitor your shipment.
We would ask you to pay the return costs in advance but promise to refund you the amount shown on the "Return Form".
Please note that items returned incomplete, ruined,damaged or soiled will not be taken back.
You should allow approximately 10 days from your validation by email in which to receive the refund on your VAT-inclusive invoice.
Please note also that the refund will only be made to the person who initially paid for the article online, by crediting his/her bankcard.
9. Guarantees - After-sales service
9.1 Legal guarantees
The ordered items are covered by a legal guarantee of compliance and by a guarantee against hidden defects, in accordance with the legal provisions in force (items L. 211-1 to L. 212-1 of the Consumer Regulations- items 1641 to 1649 of the Civil Code).
You have a period of 2 years in which to invoke the above guarantees by contacting Longchamp's After-sales Department. This period runs from the delivery of the items for the legal obligation of compliance (itemsL. 211-12 of the Consumer code) and from the discovery of the defect for the hidden defects guarantee (article 1648 of the Civil Code).
9.2 LONGCHAMP guarantee
The items on sale comply with the French regulations in force. They benefit from Longchamp expertise and quality.
They are thus guaranteed against any manufacturing faults. If such a fault occurs, Longchamp will repair your purchase free of charge, or exchange it. Exchanged items will not be returned.
The Longchamp guarantee obviously does not cover normal wear and tear, accidental damage or damage caused by the use of a solvent or by the abnormal use of the article.
Damage caused during air transport should be reported immediately to the airline concerned, which will take responsibility for the claim.
9.3 LONGCHAMP After-sales Service
LONGCHAMP After-sales Service is responsible for repairs covered by Legal Guarantees and the Longchamp guarantee, and for any wear-and-tear repairs to your items.
All the Longchamp retail stores are at your disposal so that you can leave them your article to repair.

Otherwise, please contact another retail store near your home.
Your article will be sent to our workshops, where an appropriate decision will be taken:
- free repair or replacement by a new article of an equivalent value for items that contain a manufacturing defect that has been observed and validated by our workshops.
- repair (charged) for worn items. The price list for the most common repairs is available in all retail outlets. If the damage has been caused by you or a third party, we will offer you an estimate.
- no repair and return of the article if it is too worn-out.
10. Liability
We are not liable:
- for a possible difference in color between "the screen and reality".
- for the wording of the personal message accompanying your gift and any consequences thereof.
- for the customisation choices made on the article that are not suitable, even if it is a gift.
Furthermore, we may not be considered liable or deficient with regard to any delay or non-fulfilment arising out of the occurrence of a case of "force majeure".
Finally, please note that we may not be held liable for any order placed by a minor whose parents may or may not have authorised the order.
11. Document conservation
For all orders over 150 US dollars, we undertake to keep the documents relating to the transaction for a period of 10 consecutive years. We guarantee your access to them at any time, on simple request.
12. Computers and Individual Liberties
Your personal information is necessary in order to process your order, and at no time will this information be sold, marketed or rented to third parties.
You have the right to access, modify, correct and oppose any information concerning you (droitdacces@longchamp.com).
13. Applicable law, disputes
These conditions, the order and all actions that arise out of them are governed by French law. In the event of a dispute, and if this cannot be settled amicably, the French courts have sole jurisdiction.
